The case that challenges Colorado’s new gun control laws, including the magazine ban, goes to trial today, and is expected to continue for several weeks. The judge in this case is the Hon. Marcia Krieger, who was put on the bench by George W. Bush, which I would say offers some possibility the Second Amendment will be taken seriously. I think a magazine ban, especially one that sets the limit at 15, is going to be a tough sell to federal judges, but I’m going to hope she’ll see through the state’s smokescreen over public safety and properly declare it unconstitutional, since magazines that hold more than fifteen rounds are in common use for lawful purpose, and are also not restricted for the police.

The courts upholding this law is already a foregone conclusion. I expect the law to be FULLY upheld by the courts. It seems when something big like this does go to court we lose. Badly.
Expect the court decision upholding the magazine ban to be used to push (the now ruled constitutional) magazine ban in every state they can get away with.
To state my lack of faith in the courts will be an understatement. After all Bloomberg can just bribe the judge.
That’s silly. They’ve always been ready to push bans in every state they can get away with. No one is waiting for a judicial green light. Pro-gun (or at least not anti-gun) legislatures are stopping them, not the courts.
This is just a District Court, so I expect she’ll rule it Constitutional. Like most of these cases, it will have to go to the Circuit Court before we see any progress.
Is it too much to hope that a judge might review the major precedents like Heller and MacDonald when making their rulings?
Here’s hoping that the judge rules the magazine limit constitutional…
…and that it applies to the police, too.
