If you’re an FFL, and you’ve gotten a demand letter, NRA-ILA’s Office of Legislative Counsel would like to speak with you. Rumor has it that some FFLs have gotten demand letters. This is an ATF demand that needs to be answered with a lawsuit, as the multi-long-gun reporting requirement is unlawful.

The problem here is the same one that kept the FFLs that reported the sales from protesting too hard when the ATF told them to do the sales anyway: ATF holds their livelihood in its hands, and subject to their merest whim.
How long will any FFL who joins in this suit last before ATF shuts them down for “paperwork violations,” or drives them out of business with constant “minor infractions” and plain old harassment? If the FFL is lucky, ATF will wait until the lawsuit is over before any retaliation. If they’re unlucky, they’ll get shut down early on so that ATF can argue for dismissal for lack of standing (“He’s not a licensed FFL, so he’s not subject to the reporting requirements”).
I’m glad I’m not in one of the reporting states, yet. I wonder how long it will be before they make all of us fill out their forms. I bet it will be within six months.
