Thanks to intrepid reader ErnieD, I have links to all nine of the Philadelphia gun control bills that were passed out of committee at city council. Keep in mind that all of these laws are in violation of the laws of the Commonwealth of Pennsylvania:
- Assault Weapons Ban
- Ban on possession for mere accusation of a crime
- License required for possession of firearms
- Temporary removal of firearms from dangerous persons
- Persons subject to restraining orders not to have firearms
- Failure to report a lost or stolen firearm
- Registration of all ammunition sales
- Rationing of Firearms
- Registration of all guns by LTCF holders
Some of these are extraordinarily bad, and will ban many common target guns, and guns such as the Glock 19C. Nutter has sworn to enforce these laws. The question is, what are we, as gun owners, going to do about it? Write your state reps, write the state attorney general, and politely ask if there’s anything they can do about this. Philadelphia is part of Pennsylvania, and subject to its laws and constitution, and we shouldn’t stand for this kind of treatment from corrupt big city politicians.
UPDATE: Rereading the assault weapons ban, it’s amazing how poorly worded it is. It bans a LOT of firearm no one would consider assault weapons, and also pretty much any ammo that’s not standard FMJ. A creative prosecutor could argue the law bans such firearms as the M1 Garand. Even a 1903 Springfield. The law pretty clearly bans firearms such as the Ruger Charger.

I hate to state the obvious, but if those people are so worried about crime, they might try locking criminals up and throwing away the keys instead of patting them on the top of the head and making them community heroes. Remember that guy this spring who held up all of those pizza places and convenience stores here? He was convicted and sentenced to 223 years, and the prosecutor is appealing the sentence because he says it should be 455 years.
Maybe our prosecutor could go to Philly and give a seminar on crime prevention.

Yep that will ban any target gun and race gun that has a compensator or porting. Also it uses the same wording as HR1022 on “Barrel Shrowd” essentially meaning “Any forend” so this would ban ALL semi-auto long-arms, as even an SKS or an M1 Garand have wooden forends that prevent burns from a hot barel or gas system.
Also the wording on “pistol grip” could include the standard Monte Carlo stock.

Crazy. The LTCF registration would require you to register any guns stored on *any* property you own/lease. But there’s no exemption for property outside the city, or even the State for that matter. How do they plan to enforce that?
So did Mayor Nutter figure in all the money the city is going to be losing in lawsuits into his budget? Just because they refuse to get a hold of that city and the scumbags that run it, both in the streets and city hall, doesn’t mean that OUR rights are cool to be trampled!
The AWB isn’t poorly written, it’s done deliberately that way. They used the same model law drafted by the Legal Community Against Gun Violence. That draft is the basis for other bills including HR-1022 in Congress, A-7331 in New York, etc.

Whether it’s deliberately poorly written, it’s still poorly written. The Philadelphia City Council may be using model legislation that was written by people who knew exactly what they were doing, but I doubt City Council knows or cares the range of firearms they are banning. I’m actually surprised they didn’t ban them all.
It is designed to ban as many guns as possible. That is why it is written that way. I am confident the City Council knows exactly what they are doing with the bill.

“Have you seen this new Ruger Charger? Damn, we have to ban that killing machine!”
“I saw that. Horrible! We must ban it! The Glock 19C too.”

Seriously, Philadelphia Council is pretty stupid. Someone probably handed them model legislation and they just slapped it on without giving it too much thought. This is means to create a confrontation with the state, more than it is to have any actual effect.
What I’m suggesting is the City Council wants to ban as many guns as possible and told their lawyers to come up with a bill to do just that. They learned after the ’94 AWB that laws which prohibit guns by name doesn’t work too well so all new AWBs look pretty much like this one.
Of course only law abiding citizens are required to register their guns, since the Supreme Court ruled in Haynes v. U.S. (1968) that criminals do not have to.
So, if I currently have a permit to carry in pennsylvania(I don’t live in philly), is philly trying to say it is invalid when I visit Philly? or have they not gone that far yet.
I also hope you are all watching the supreme court DC gun ban case closely. If they uphold that law we will likely have to register as part of a militia to maintain our right to bear arms…
They aren’t saying that yet. But they are definitely trying to buck Pennsylvania’s preemption law with this crap. I am watching the DC case closely, and I’m not sure where you’re getting the militia registration thing from.
Well the idea is for the DC case that they can ban our right to bear arms because the 2nd amendment only applies to militias. Now I of course believe it applies to individuals as well. But should the court rule that it does only apply to militias, then my suggestion is that we all register as part of a militia like the NRA. Thus, protecting our rights in that manner.
So can we all get empty 30 round mags for the AR-15 and parade around in front of City Hall with them to see if we can become the test case? I live in Allentown, only 40 miles away.
I think they’d probably leave you alone actually. I’m fairly certain the city already has their fall guy on this one.
