The meme is going around. I have pretty good faith in our system, so I wouldn’t make very many changes, other than this:
- Fire all existing supreme court justices, except for Justice Thomas. He can stay.
- Nominate Eugene Volokh to the Supreme Court
- Nominate Randy Barnett to the Supreme Court
- Nominate Glenn Reynolds to the Supreme Court
- Nominate David Hardy to to the Supreme Court
- Nominate Orin Kerr to the Supreme Court
- Nominate Judge Alex Kozinski to the Supreme Court
- Tell Congress they can stick it on the advice and consent, and order that we only need seven justices.
- Consolidate all federal law enforcement under the US Marshals.
- Put Radley Balko in charge of the USDOJ with a life time appointment.
I figure the rest will kind of sort itself out.

Hmmmm. What do you have against Roberts, Alito, and Scalia? And change Balko to Patterico. I don’t want cop haters to be anywhere near the criminal justice system, not even as janitors.
I wanted my Supreme Court balance to be between libertarians and conservatives, rather than between conservative and liberals. I figure that will mean either way, I win.
As far as Balko being in charge of the DOJ… well… the federal government isn’t supposed to have a police power, except in Washington D.C and in US territories. Of course, DOJ isn’t responsible for territories, DOI is.

I agree that a balance between conservatives and libertarians is preferable to a balance between conservatives and liberals, but I’d rather see the balance between sensible libertarians and sensible conservatives. Putting Balko in charge of anything except maybe a loony bin would poison that model.
Also, I’m not sure your supreme court lineup would accomplish nearly as much as you envision. Of the individuals you named, only Barnett has shown any indication of holding the “anything I really, really don’t like is unconstitutional” mindset, which is more characteristic of liberals. Most gun laws would be struck down, of course, but when it comes to just about everything else, we’d see a string of 6-1 decisions upholding laws all seven can agree are “uncommonly silly,” but which only one can find a “living” Constitution to prohibit.
I really don’t care what the personal politics of the SCOTUS judges are, as long as they’re originalists. Their politics should never intrude into their decisions.
